Giving tenants control: Right to Transfer and Right to Manage

The Department of Communities and Local Government are consulting on the above document that proposes to make it easier for tenants to exercise the Right to Manage and includes new Right to Transfer regulations.  The aims are to ensure that decisions about ownership and management of Local Authority housing are made locally and that tenants are empowered to shape services that they receive and where prudent take control of housing or explore transfer options and manage local housing services.

The main changes/proposals:

- require LAs to cooperate with tenants who want to explore transfer options

- however this should be balanced with support for transfer not being detrimental to the LAs wider housing services

- to ensure that under Right to Manage regulations the responsibility for transferring the management of services to tenants is a local decision

- to remove requirement in the RTM regulations for LA to prepare a feasibility study on prospective TMO in relation to proposals to exercise RTM

- intention to explore 'fast track' approaches to RTM.
